Detention facilities in the district
Two facilities account for much of the immigration detention in South Florida. The Krome North Service Processing Center, on the western edge of Miami-Dade County, is operated by ICE. The Broward Transitional Center in Pompano Beach is a privately operated facility used by ICE. People held in either facility are confined within the Southern District of Florida, so under the district-of-confinement rule from Rumsfeld v. Padilla their habeas petitions are generally filed there.
Detainees are sometimes initially held at local jails or at facilities in other parts of Florida, which fall within the Middle or Northern Districts. Confirming the exact facility before filing is essential, since a petition filed in the wrong district can be dismissed or transferred, costing valuable time.
How the court is organized
The Southern District of Florida sits in five divisions: Miami, Fort Lauderdale, West Palm Beach, Fort Pierce, and Key West. Cases are generally assigned to the division connected to where the claim arose. Filings are made electronically, and the court has local rules governing formatting, page limits, and emergency motions that a petition must follow.
The Eleventh Circuit
Appeals from the Southern District go to the U.S. Court of Appeals for the Eleventh Circuit, which also covers the rest of Florida, Georgia, and Alabama. Its decisions bind district judges in Miami and shape how arguments about prolonged detention, mandatory detention, and exhaustion are received. Because circuits differ on these questions after Jennings v. Rodriguez, a petition filed in Miami should be built on Eleventh Circuit and Southern District authority rather than on cases from elsewhere.
Why local experience matters
Habeas practice is highly procedural. Knowing how judges in the district typically handle orders to show cause, how quickly the U.S. Attorney’s Office responds, and how individual judges treat requests for emergency relief allows a petition to be framed for the court that will actually read it. A Miami-based practice can also coordinate directly with the detainee, their family, and immigration counsel handling the removal case.
